End-User Licence Agreement

CipSoft GmbH, based in Regensburg, Germany (“CipSoft”) sells computer games (“Game”) developed by partners (“Partner”). This End-User Licence Agreement (“Agreement”) governs the terms under which CipSoft offers you these Games. By purchasing a Game, you accept this Agreement and confirm that you are legally competent in your country or have the permission of your parents or legal guardian to purchase the Game

1 Contracting Parties

The agreement is formed between you and CipSoft. For any questions or issues, please contact CipSoft, not the Partner.

2 Subject of the Contract

CipSoft grants you a fee-based, non-exclusive and non-transferable licence for the permanent use of the selected Game for your personal, private use. This licence does not establish any ownership rights to the Game. All rights not explicitly mentioned in this Agreement remain with CipSoft or the Partner. Before purchasing, please check that your computer meets the system requirements of the Game and you have a working internet connection. The Game will be made available by the Partner or on a platform for download in compiled form. CipSoft will provide you with a licence key that allows you to access the Game. You must provide a valid email address for this purpose. The licence key may not be passed on to third parties. In some Games it may be possible to unlock additional game content for a fee or to purchase virtual goods. This is not the subject of this Agreement. The Partner reserves the right to further develop the Game and to release new versions from time to time.

3 Terms of Payment

The current valid price for the Game will be displayed to you during the ordering process. This price includes any applicable value added taxes and other excise or transaction taxes. Additional charges may apply for certain payment methods. CipSoft reserves the right to change the price at any time. You must pay the price in advance. By providing payment information, you affirm that you are the authorised user of the payment method used for this transaction. The licence key will only be provided to you when CipSoft, or an involved payment service provider, receives the payment. If the payment is subsequently withdrawn or returned, the licence key will be disabled.

4 Right of Withdrawal

You have the right to withdraw from this Agreement without giving any reason within 14 days of purchase, provided you have not yet used the licence key (“Right of Withdrawal”). To exercise the Right of Withdrawal, you must inform CipSoft in an unequivocal statement about your decision to withdraw from this contract (e.g. by sending a letter to CipSoft GmbH, Prüfeninger Str. 20, 93049 Regensburg, Germany or an email to [email protected]). You may use the withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the Right of Withdrawal before the withdrawal period has expired. If you withdraw from this Agreement, we will refund all payments received from you in connection with this Agreement without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. The refund will be made by the method of payment you used for the original payments unless you have expressly agreed otherwise with us.

5 Warranties and Limitation of Liability

The Game is provided “as is.” CipSoft disclaims all warranties or representations, in particular regarding the absence of errors and fitness for a particular purpose. You shall not hold CipSoft liable for any loss of profits or other damages arising out of or in connection with the use of the Game, unless such damages were caused by CipSoft’s wilful misconduct or gross negligence.

6 Final Provisions

Should individual provisions of this Agreement be or become invalid in whole or in part, the remaining provisions shall not be affected thereby. The provision in question shall be replaced by a valid one that comes as close as possible to the intended economic purpose. The Agreement is subject to the law of the Federal Republic of Germany, excluding the provisions of international private law and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Regensburg. CipSoft GmbH is neither willing nor required to take part in out-of-court dispute resolution.

When you purchase a Game, CipSoft processes the data you provide to process the payment. The data is also used to detect and prevent fraudulent payments. When you contact CipSoft's support, CipSoft processes your email address and other personal data in order to respond to your request efficiently and satisfactorily. CipSoft also uses this data in an anonymous and aggregated form to optimise the work of the support.

Cookies

When you visit our website, we may store information on your computer in the form of cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters by which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This enables the visited Internet pages and servers to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. A specific internet browser can be recognised and identified via the unique cookie ID.
Through the use of session cookies, the controller can provide the users of this website with a user-friendly service that would not be possible without the setting of cookies. Without consent, we only use technically necessary cookies on the legal basis of legitimate interest pursuant to Art. 6 (1) lit. f GDPR.
We only use personal cookies to improve our website or for marketing/advertising purposes with your consent. On your first visit, you can voluntarily agree to tracking or analysis by clicking on the cookie banner. Your data may be passed on to partners or third-party providers. These cookies are only stored if you explicitly agree to this; the legal basis is then your consent in accordance with Art. 6 Para. 1 lit. a GDPR. You can change your settings for the use of cookies at any time.

Google Consent Mode

We carry out tracking via Google Ads. We use this to track behaviour on our website so that we can optimise the content for you and check the success of our advertising campaigns. Of course, tracking only takes place if you have given your consent via the cookie banner. We would also like to point out that if no consent has been given for personalised tracking, a non-personalised and cookie-free analysis will take place. The following data is processed:

In this way, we can track the flow of visitors to our website (but not individual user behaviour). The legal basis here is your consent in accordance with Art. 6 para. 1 lit. a GDPR, which you can revoke at any time.

Function-related information (such as headers that have been passively added by the browser):

  • Timestamp
  • User agent
  • Referrer URL

Aggregated or non-personal data:

  • Indication of whether the current page or a previous page in the user's navigation history on the website contains ad click information in the URL (e.g. GCLID/DCLID)
  • Boolean information on the consent status
  • Random number generated when the respective page is loaded

Google Conversion Tracking

This website uses Google Conversion Tracking. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We do not receive any information with which we can personally identify the user. Google itself uses cookies or comparable recognition technologies for identification.

YouTube

This website embeds videos from YouTube. The operator of the pages is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in extended data protection mode. According to YouTube, this mode has the effect that YouTube does not store any information about visitors to this website before they view the video. However, the transfer of data to YouTube partners is not necessarily excluded by the extended data protection mode. Thus, YouTube - regardless of whether you watch a video - establishes a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to the servers of YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube can save various cookies on your end device after starting a video or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve the user experience, and prevent fraud attempts.

Since a corresponding consent was requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. The consent can be revoked at any time.

For more information about data protection at YouTube, please see their privacy policy at: https://policies.google.com/privacy?hl=de.

For this purpose, a so-called click ID is generated and stored when you click on a CPMStar advert.
